Terms of Service

Last updated 14 October 2026

The service

DigMyGem is a hosted language learning reader. You may use it as it is. We may add, change, or remove a feature, and we may stop offering the service.

Who you are agreeing with

“We” is Jiawen Lin, trading as DigMyGem, Lorcan Drive, Dublin, Ireland — an individual, not a company, who operates DigMyGem and provides the service under the name DigMyGem. Paying for a plan is a separate purchase from Paddle — see Paying for DigMyGem below.

Your account

You must be at least 16 years old. Keep your password and your sign-in method secure, and tell us at hello@digmygem.com if you think someone else is using your account. You are responsible for what happens through your account.

Your content

What you write and what you import stays yours. You give us the permission we need to store it and to show it back to you. Import only content you have the right to use. We remove content when a rights holder asks us to.

Acceptable use

Do not use DigMyGem to break the law, to attack or overload the service, to reach another person's data, or to resell access to it. Do not use the import feature to build a copy of a site that forbids it.

Other services

Translation and explanation call an AI provider. If you configure your own provider, your use of it is between you and that provider. Sign-in through Google or GitHub is also subject to that provider's terms.

Plans and prices

DigMyGem has three plans. Free costs nothing. Pro is USD 10 a month or USD 100 a year. Ultra is USD 30 a month or USD 300 a year. Each plan has its own limits, shown in the app and on the Pricing page, which anyone can read without signing in. Prices are in US dollars and exclude any sales tax or VAT, which Paddle calculates and adds at checkout.

We may change a price. A change never affects a period you have already paid for, and we tell you before a renewal at the new price.

Paying for DigMyGem

Paddle is our merchant of record. That means Paddle is the seller of the subscription, not a payment processor working for us. When you subscribe, you buy from Paddle: Paddle is the name on your invoice and on your card statement, Paddle charges and remits the sales tax or VAT, and Paddle holds the purchase contract for the payment. Paddle's own terms (its checkout buyer terms at paddle.com/legal) and privacy notice apply to that purchase alongside these terms. If the two conflict about the payment, Paddle's terms decide the payment and these terms decide the rest.

We ask Paddle to open checkout for the plan you picked, and Paddle tells us that the subscription is active. Your card details never reach us.

Term and renewal

A subscription runs for the period you chose — one month or one year — and renews automatically for another period of the same length until you cancel. Paddle charges the payment method on file at each renewal.

If a payment fails, Paddle retries it over the following days. Your plan keeps working while it retries. If the retries run out, the subscription ends and the account drops back to Free.

Changing or cancelling your plan

On a cloud account, your plan is in Settings, in the DigMyGem plan section. The button there opens Paddle's portal, where you cancel or change your payment method. It reads Manage billing on a paid plan and Billing history on Free, and it appears once Paddle holds a billing account for you. Cancelling stops the next charge — the plan keeps working until the end of the period you have paid for, and then the account returns to Free.

Moving up to a larger plan takes effect at once and is charged for the rest of the period. Moving down from Ultra to Pro, keeping the same billing period, takes effect at your next renewal. Every other change takes effect at once — including any move between a monthly and an annual period — and Paddle works out the difference for the rest of the period. We cannot change your plan while a payment is failing: settle the payment first, or cancel.

Your library and your learning history stay with you on Free. Only the limits change.

Refunds

Any subscription payment can be refunded within 14 days. The Refund Policy is part of these terms and says what happens after that, and how to ask.

Availability

DigMyGem is provided as it is, without a warranty. We do not promise uninterrupted service, and we do not promise that data will never be lost. Export the data that matters to you.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing here limits a right you have under Irish consumer law.

Ending it

You can delete your account at any time on the Account page. We email you a confirmation link, and nothing is removed until you click it. We may suspend or close an account that breaks these terms, and we will say why.

What happens when it ends

When an account is deleted or closed, your access stops and so does your plan. A paid plan is not charged again; a refund follows the Refund Policy. We delete your library and your learning history, and the last backup that holds a copy ages out within 14 days. Export what matters to you first: after deletion we cannot restore it.

The permission you gave us to store and show your content ends with the account. What was already owed, the limits on our liability, the section on what you owe us, the governing law and the way we settle disputes stay in force after the end.

What you owe us

You will cover us for loss, damage and reasonable costs that come from a claim by someone else and are caused by your breach of these terms, by content you imported or wrote without the right to use it, or by your unlawful use of DigMyGem. We tell you about the claim promptly and let you help deal with it. This does not apply where the law does not allow it against a consumer, and it never reaches a right you have under consumer law.

Changes to these terms

We change the date at the top when these terms change. A material change is announced in the app before it takes effect. If you do not accept a change, you can cancel your plan and delete your account.

Assignment

You may not transfer your account or your rights under these terms to anyone else. We may transfer them to a person or company that takes over DigMyGem, if it keeps the protections in these terms and the Privacy Policy, and we tell you in the app or by email first.

Events beyond our control

Neither of us is in breach for a delay or failure caused by something beyond reasonable control, such as an outage at a hosting, network or payment provider, a power or internet failure, an act of government, or a natural event. This does not excuse a payment already due, and it does not take away your right to a refund.

Governing law and disputes

These terms follow the law of Ireland.

If something goes wrong, write to us first at hello@digmygem.com and we will try to settle it with you. If we cannot, the courts of Ireland have jurisdiction. If you are a consumer, you keep the mandatory consumer protection of the country where you live, and you may bring a claim in the courts there.

These terms are written in English. If a translation, a summary, or any description in another language says something different, the English text controls.
